Syracuse, N.Y. — The city of Syracuse’s efforts to shut down unlicensed marijuana sellers is facing renewed pushback in court after a shop accused of selling weed pre-emptively sued the city over its enforcement policies.

The landlord at The Herbal Center on the North Side filed a lawsuit last week asking a judge to prevent the city from shutting down its operation, saying the city doesn’t have the authority. The next day, the city filed its own suit, claiming The Herbal Center is operating an weed lounge and selling cannabis without a state license, making those activities illegal.
