In a time-sensitive matter of paramount importance, we, a coalition of 175 concerned CAURD stakeholders within New York’s cannabis industry, urgently request Gov. Kathy Hochul to intervene and address the critical situation arising from the codification of the CAURD (Conditional Adult Use Retail Dispensary) program.
This plea comes as the industry faces its second TRO (Temporary Restraining Order) lawsuit, which, if not resolved by August 25, could result in the collapse of the entire cannabis market across the state. Recognizing the importance of the matter, we urge the governor to convene a special legislative session to address this pressing issue.
While we understand that such actions may present challenges and inconveniences, we beg Gov. Hochul to consider the millions of New Yorkers with regards to the distribution of regulated cannabis. The Office of Cannabis Management had promised all 463 licensed applicants the opportunity to serve their communities safe and regulated cannabis, yet only 22 are currently operating at minimal capacity.
It is crucial to note that the first injunction back in 2022, which lasted for six months, inflicted a significant setback upon New York’s cannabis industry. Our coalition’s unwavering efforts have been primarily focused on improving its members’ ability to survive in this highly volatile environment. Nevertheless, the absence of proper codification into the Marijuana Regulation and Taxation Act (MRTA) has only proven to be a liability to the applicants, the public and the safety of cannabis consumers.
The adverse effects of this situation extend to all industry stakeholders, including the AUCCs, AUCPs, the medical cannabis community, the CAURD applicants and licensees, as well as the ancillary businesses surrounding the sector. The repercussions of inaction are far-reaching and threaten the stability, growth, and reputation of New York’s cannabis industry.
Again, we need Gov. Hochul to intervene immediately and take decisive action. The eyes of the entire state are upon us, watching closely to witness the leadership and commitment that earned her the trust of the people as governor. By addressing this urgent matter, she will reinforce the belief that she is dedicated to upholding the promises made to her constituents.
